When you use our website (https://3baraquatics.com) or buy fish from us, you’re agreeing to follow these Terms and Conditions along with our Refund Policy and Privacy Policy. If something here doesn’t work for you, that’s totally okay but unfortunately you won’t be able to use our website or buy from us.

3. Who Can Buy From Us
3.1 You Need to Be 18 or Older
- You must be at least 18 years old to purchase from 3bar Aquatics
- By placing an order, you’re confirming that you’re old enough to make legally binding purchases
3.2 Keep Your Info Up to Date
- Please make sure your account information is accurate
- We need a valid shipping address and phone number to reach you
- If something looks fishy (pun intended!) with your order info, we might need to cancel it or reach out to verify
4. About Our Fish and Products
4.1 Every Fish is Unique
We’re selling living creatures, and just like people, every fish is a little different!
- Size : The sizes we list are close estimates. Your fish might be a little bigger or smaller within that range
- Color : Photos are as accurate as possible, but actual colors can vary based on the fish’s age, diet, stress level, and even our camera! They might look slightly different in your tank
- Sex : Unless we specifically say “male” or “female,” we’re sending unsexed fish. We can’t guarantee which sex you’ll get
- Personality : Each fish has its own temperament. Some are shy, some are outgoing just like us!
4.2 Stock Availability
- What you see on our website depends on what we have in stock right now
- Sometimes we might need to limit how many you can buy, or we might even have to turn down an order
- If something sells out after you order it, we’ll get in touch with other options or give you a refund
- Our stock updates regularly, but what’s shown online might not be 100% current if lots of people are ordering at once
4.3 Pricing
- All prices are in US dollars and can change without notice (we try to keep things stable, but costs do fluctuate)
- If we accidentally post the wrong price, we’ll let you know before shipping anything
5. Placing Your Order and Payment
5.1 How Orders Work
- Your order isn’t official until you get a confirmation email from us
- Sometimes we might need to cancel or refuse an order (suspected fraud, out of stock, pricing mistakes, etc.)
5.2 Payment Options
- We accept all major credit cards, debit cards, and whatever payment methods you see at checkout
- We need full payment before we can ship your fish
- When you enter your payment info, you’re giving us the okay to charge you for the total amount
5.3 Sales Tax
- We’ll calculate any applicable sales tax at checkout based on where you live
6. Shipping and Getting Your Fish to You
6.1 How We Ship
- We ship live fish via overnight or express shipping to make sure they arrive safe and sound
- When we ship depends on weather and our shipping schedule
- We usually ship Monday through Wednesday so your fish don’t get stuck somewhere over the weekend
- You’ll get tracking info as soon as your package ships
6.2 Double-Check Your Address!
- Please, please, please make sure your shipping address is correct! We can’t deliver to the wrong place
- If you made a mistake with your address, we’re not responsible for where your package ends up
- Need to change your address? Let us know ASAP after ordering
- Once your fish are on the road, we can’t redirect the package
6.3 Someone Needs to Be Home
- Make sure someone’s around to grab the package when it arrives
- The delivery person might need a signature
- We can’t be responsible if no one’s there to accept the delivery or if the package sits outside
- Don’t ship to PO Boxes or places where the temperature can’t be controlled
6.4 When the Weather's Not Cooperating
- If it’s too hot (over 95°F) or too cold (under 40°F), we might hold your shipment for your fish’s safety
- We’ll let you know if we need to wait for better weather
- If you want us to ship anyway (even though we recommend against it), you’re taking the risk and giving up your DOA protection
6.5 Where We Ship
- Right now, we only ship within the continental United States
- Sorry, but we can’t ship to Hawaii, Alaska, or US territories at this time
- Interested in international shipping? Contact us we might expand in the future!
7. Live Arrival Guarantee and Returns

- Return policy (live fish cannot be returned except under DOA policy)

8. What You Need to Know as a Fish Owner
8.1 Taking Care of Your Fish
- You’re responsible for making sure your tank is the right size with the right water conditions for your fish
- Please do your research before buying! Know what each species needs
- We can’t be held responsible if your fish gets sick because of poor tank conditions or incompatible tank mates
8.2 Acclimation is Key!
- Proper acclimation is super important it’s often the difference between life and death for your new fish
- Please follow the acclimation instructions we include with your shipment
- If you skip proper acclimation, our DOA protection doesn’t apply
8.3 Make Sure It's Legal
- Some fish species are illegal in certain states or cities
- It’s your responsibility to make sure you’re allowed to own the fish you’re ordering
- If your local laws prohibit a species and it gets confiscated, that’s not on us
9. Our Content and Images
9.1 Website Stuff
- Everything on our website text, pictures, logos, design belongs to 3bar Aquatics or the people we got it from
- Please don’t copy, share, or modify our content without asking us first
9.2 Fish Photos
- All our fish photography either belongs to us or we have permission from our exporters to use it
- Please don’t use our product images without permission
10. The Legal Stuff About Liability
10.1 What We Can and Can't Promise
We’re selling living animals, and we can only guarantee they’ll arrive alive (that’s our Live Arrival Guarantee).
- We can’t promise things like long-term health, breeding success, or specific behaviors fish are individuals!
- We’re not responsible for indirect damages or consequences beyond your control
- If something goes wrong, our liability maxes out at what you paid for the fish
10.2 When Things Are Out of Our Control
- Sometimes stuff happens that’s beyond anyone’s control natural disasters, shipping carrier problems, pandemics, government shutdowns, etc.
- We’re not liable for delays or issues caused by these kinds of situations
11. Your Privacy Matters
- We take your privacy seriously. Check out our Privacy Policy to see how we handle your information
- By using our website, you’re okay with how we collect and use your data as explained in that policy
12. How We'll Stay in Touch
12.1 Marketing Emails
- When you give us your email, we might send you cool updates about new fish, sales, and tips
- Not interested? No problem! Just click “unsubscribe” in any email
- We’ll still need to send you important emails about your orders those can’t be turned off

13. If There's Ever a Problem
13.1 Which Laws Apply
- These terms follow Tennessee state laws (that’s where we’re based!)
- If there’s ever a legal dispute, it’ll be handled in Tennessee courts

- Before anyone gets lawyers involved, please just talk to us! We’re reasonable people and want to make things right

14. We Might Update These Terms
- Sometimes we need to change these terms and conditions

15. If Part of This Doesn't Work
If a court decides that one part of these terms isn’t valid, don’t worry the rest still applies. We’re not throwing out the whole thing just because of one section!
16. This is the Whole Agreement
These Terms and Conditions, along with our Refund Policy and Privacy Policy, make up our complete agreement with you. This is everything nothing else counts unless we both agree to it in writing.
